I, the above-named Volunteer (“Volunteer”), desire to volunteer for Shootout for Soldiers (“SFS”) and engage in the activities related to an event which is part of Shootout for Soldiers Events (the “Event”). I hereby voluntarily, execute this Volunteer Waiver (“Waiver”) under the following terms:

I, the Volunteer, being of at least eighteen (18) years of age, or if under the age of 18, the legal guardian/parent of such Volunteer, release and hold harmless Shootout for Soldiers, its officers, directors, agents, employees and any/all related entities (individually and collectively, the “SFS Entities”) its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer work with Shootout for Soldiers and the Event.

I understand that the scope of my relationship with Shootout for Soldiers and the Shootout for Soldiers Entities is limited to a volunteer position and that no compensation is expected in return for services provided by myself/Volunteer; that Shootout for Soldiers and the Shootout for Soldiers will not provide any benefits traditionally associated with employment to myself/Volunteer; and that I/Volunteer am/is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of my service at the Event.

I understand that the nature of the volunteer activities that I may perform in my capacity as a Volunteer may involve physical activity, contain with unidentified or unfamiliar persons or other potential risk of bodily injury or damage to property and I hereby voluntarily assume full and complete responsibility for, and the risk of, any injury or accident which may occur during my volunteer work with Shootout for Soldiers.

I understand that this Waiver discharges Shootout for Soldiers/the Shootout for Soldiers Entities from any liability or claim that I, the Volunteer, may have against Shootout for Soldiers/the Shootout for Soldiers Entities with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation. I also fully understand that Shootout for Soldiers/the Shootout for Soldiers Entities do not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage. I understand that I expressly waive any such claim for compensation or liability on the part of Shootout for Soldiers/the Shootout for Soldiers Entities in the event of such injury or medical expense. I hereby release Shootout for Soldiers/the Shootout for Soldiers Entities from any claim whatsoever which arises or may arise in the future on account of any first aid treatment or other medical services that are conducted in connection with an emergency during my time with Shootout for Soldiers. At all times during my volunteer work with Shootout for Soldiers/the Shootout for Soldiers Entities, I will conduct myself in such a manner as not to reflect unfavorably on or in any way diminish the reputation of the Shootout for Soldiers/the Shootout for Soldiers Entities.

I grant Shootout for Soldiers and the Shootout for Soldiers Entities, my consent and full right to use my name, photograph, likeness, image, voice, and biography in any and all media, including, but not limited to, any forms of social media, publications, advertising, and publicity in connection with my participation hereunder.

I waive any rights, claims or interest which I, my minor children, heirs or assigns, may have to control the use of my identity or likeness in whatever form of media used. Additionally, by signing this document, I release and forever discharge Shootout for Soldiers/the Shootout for Soldiers Entities from any and all claims or liabilities of any kind which may arise from the use of my name, photograph, likeness, image, voice, and biography. I acknowledge and agree that I will not receive any compensation in connection with any use of my name, photograph, likeness, image, voice, and biography.

I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the state in which the Event is located and shall be governed by and interpreted in accordance with the laws of the state in which the Event is located.

I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, Shootout for Soldiers shall have the right to modify such clause or provision to the extent necessary to be deemed enforceable and the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Waiver which shall continue to enforceable.

By signing, I represent that I am at least 18 years of age, have read and understand the terms within this Waiver, and am competent to execute this Waiver.

For minors (those under the age of 18), I represent that I am the parent/legal guardian of the above-referenced Volunteer and that I have read and understand all terms within this Waiver and have the authority to execute this on behalf of the above-named minor volunteer.
